Long Beach Attorneys Representing Employees with Unpaid Termination Wages Claims
California employment and labor laws require employers to pay employees in a timely manner upon termination of employment — whether a worker quits, is fired, or is laid off.
Employers who Routinely Delay Final Payment of Wages Due When Firing Employees.
Specifically, employers are expected to pay all wages owed immediately after firing or discharging an employee, or within 72 hours when a worker quits. This includes not only wages for hours worked, but can also include compensation for accumulated paid time off. Employers may have an ongoing pattern of disregarding the law concerning payment of wages upon termination of employment.
"Waiting time penalty." If an employer willfully fails to pay any wages of an employee who is discharged or who quits, the wages of the employee shall continue as a penalty from the due date thereof at the same rate until paid or until an action therefore is commenced, but the wages shall not continue for more than 30 days. Thus, this penalty would apply to all wages owed to former employees, including overtime premium, meal period premium, rest period premium, reporting time pay, and split shift premium.
